DOMESTIC CONTRACTS
Prior to getting married or cohabiting, executing a domestic contract will protect you and your assets in the event of separation. A domestic contract may also be entered into after marriage or when already cohabiting.
A domestic contract may be particularly appropriate for those persons entering into a second marriage or relationship where one or both parties have children and wish to ensure that any division of property upon death or separation preserves assets for those children.
SEPARATION AGREEMENTS
If you are separating from your spouse and can agree on all or most issues, then it is in your best interest to document the terms of your agreement in a separation agreement. Entering into a separation agreement will also ensure that issues which you may not have considered will be dealt with.
LITIGATION
If you cannot agree then you may need to go to court. You are not required to have a lawyer represent you but the court process can be confusing and it is in your best interest to retain a lawyer.
UNCONTESTED DIVORCE
Obtaining a divorce order from the court can also be a confusing and frustrating endeavour, even when both parties consent. We can assist you in this process as well and will charge a set fee plus disbursements to do so.
